1. Acceptance of Terms
By accessing or using DreamCraftr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and DreamCraftr.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
2. Description of Service
DreamCraftr is an AI-powered platform that enables users to create illustrated storybooks. The Service includes story generation, a personal story library, a public discovery feed, community reviews, and credit-based billing. Stories are generated using artificial intelligence based on the prompts, characters, and preferences you provide.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use DreamCraftr. The Service is designed for adults, including parents, educators, and guardians, who wish to create storybooks for children. By creating an account, you represent and warrant that you meet these eligibility requirements.
Children under 13 (or 16 in the EEA) may not create accounts or use the Service directly. If you are a parent or guardian allowing a minor to view stories created through the Service, you are responsible for supervising their access.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information when creating your account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- You may delete your account at any time through the Profile Settings page, which will permanently remove all your data from our systems.
5. Credits, Payments, and Subscriptions
5.1 Credits
DreamCraftr uses a credit-based system. Credits are required to generate stories. Credits may be purchased as one-time packs or through a subscription plan. Credits are non-transferable and have no cash value.
5.2 Payments
All payments are processed by our third-party payment processor. By making a purchase, you also agree to the payment processor's terms of service. Prices are displayed at the time of purchase and are subject to change.
5.3 Subscriptions
Subscription plans renew automatically at the end of each billing cycle. You may pause, resume, or cancel your subscription at any time through the Billing page. Cancellation takes effect at the end of the current billing period. Unused subscription credits do not roll over between billing periods unless otherwise stated.
5.4 Refunds
Refunds are handled on a case-by-case basis. If a story generation fails due to a technical error on our part, we will refund the credits used. For payment-related refunds, please contact our support. One-time credit purchases are generally non-refundable once credits have been used.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of the text prompts, character descriptions, and other inputs you provide to create stories. Stories generated by the Service are created for your personal and non-commercial use unless otherwise agreed. You may share, print, and distribute stories you create for personal, educational, or non-commercial purposes.
6.2 AI-Generated Content
Stories and illustrations are generated by artificial intelligence. AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results. You are responsible for reviewing all generated content before sharing or publishing it. DreamCraftr does not guarantee the accuracy, appropriateness, or quality of AI-generated content.
6.3 Public Content
When you set a story's visibility to "public," it becomes visible to other authenticated users in the Discover feed. By publishing a story, you grant DreamCraftr a non-exclusive, royalty-free license to display and distribute that content within the platform. You may unpublish your story at any time, which removes it from the public feed.
6.4 DreamCraftr IP
The DreamCraftr name, logo, website design, and platform code are the intellectual property of DreamCraftr. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.
7. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Generate content that exploits, harms, or endangers children in any way.
- Attempt to manipulate, exploit, or circumvent the credit system or billing mechanisms.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use automated tools, bots, or scripts to access the Service without our permission.
- Infringe upon the intellectual property rights of others.
- Use the Service for commercial purposes without our prior written consent.
- Violate any applicable local, national, or international law or regulation.
We reserve the right to remove content, suspend, or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.
8. Reviews and Community Guidelines
When you leave a review on a published story, your display name and review content are visible to other users. Reviews should be honest, constructive, and respectful. We reserve the right to remove reviews that are abusive, spam, or otherwise violate our community guidelines. Story authors may also report inappropriate reviews for moderation.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated stories and illustrations may contain errors, inconsistencies, or unexpected content. You use the Service at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMCRAFTR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to DreamCraftr in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless DreamCraftr, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the Profile Settings page. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.
Sections 6 (Content and Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), and 11 (Indemnification) shall survive termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or resolved in a court of competent jurisdiction.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
